NPA (Non-Performing Assets) and OTS (One-Time Settlement) finance are important concepts in the Indian financial sector. NPA refers to loans or advances that have defaulted, resulting in a reduction in profits and increased bankruptcy risk for financial institutions. OTS is a mutually agreed-upon settlement between the borrower and lender, with the borrower paying a reduced amount to settle the outstanding loan, and the lender waiving off the remaining amount. The Central Government has constituted National Company Law Tribunal (NCLT) under section 408 of the Companies Act, 2013 (18 of 2013) w.e.f. 01st June 2016. Banks also releases OTS schemes from time to time, which encourages NPA account holders to pay their debt at reduced prices.
