INTRODUCTION
• Trump administration has relaxed the H-1B visa restrictions it 
had imposed earlier banning entry of foreign workers.
• They have decided to allow those workers who are seeking to 
return to the country with H-1B visa for the same job they held 
before the lockdown.

• The H-1B visa is a non-immigrant visa that allows US companies 
to employ foreign workers in specialty occupations that require 
theoretical or technical expertise.

• The relaxation on visa ban will also allow spouses of these 
workers to return to the United States.

visa categories, including the H-1B

PREVENTING FEDERAL AGENCIES
• In a huge blow to Indian IT professionals, President Donald 
Trump signed an executive order preventing federal agencies 
from contracting or subcontracting foreign workers mainly 
those on H-1B visa from hiring.

• Top US tech firms including Amazon and Facebook filed a legal 
brief backing a challenge to Donald Trump's temporary ban on 
the entry of certain foreign workers.

 EXCEPTION
• The exceptions to the President’s proclamation of June 22, 
10052, commonly referred to as the H-1B or L-1 travel ban, 
include family members of the H-1B, L-1 and certain categories 
of J1- Visa.

 HEALTH SECTOR WORKERS
• Also excluded are all persons with H-1B visas who work in the 
health sector, particularly in connection with the COVID-19 
pandemic.
• To conduct ongoing medical research in an area with significant 
public health benefits the travel ban will be excluded from July 
22nd.

 LABOUR CONDITION APPLICATIONS (LCAS)
• In cases where Labour Condition Applications (LCAs) were 
approved during or after July 2020 the case is different.
•  The consultant officer must be able to use the visa application 
to determine the worker’s ongoing needs with the U.S. 
employer.

• The positions within the petitions company suggested by the 
applicant indicate that the individual is making significant 
contributions to an employer meeting a critical infrastructure 
need.

• The wage rate paid to the H-1B applicant significantly exceeds 
the applicable wage rate by at least 15 percent.
• If an H-1B applicant is receiving wages well in excess of the 
applicable wage means the employee is fulfilling an important 
business need.
