AIRCRAFT AMENDMENT
BILL 2020
INTRODUCTION
• The Rajya Sabha passed the Aircraft
(Amendment) Bill 2020, which was tabled by
civil aviation minister Hardeep Singh Puri, on
the upper house of the parliament.

AVIATION AGENCIES
• The Aircraft (Amendment) Bill 2020, which
has already been cleared by the Lok Sabha in
March this year, seeks to convert aviation
agencies like
• The Directorate General of Civil Aviation
(DGCA)
• Bureau of Civil aviation security (BCAS)
• Aircraft Accident Investigation Bureau (AAIB)

VIOLATION
• Under its implementation, any violation
under the act will attract heavy punishment.
• For example, carrying arms, ammunition, and
explosives or other banned goods on board,
and developing illegal construction around
the airports will attract fines up to ₹10 lakhs
to ₹1 crore.

WHAT IS THE AMENDMENT ABOUT?
• The bill will convert agencies under the
Ministry of Civil Aviation, into statutory
bodies.
• A statutory body is one that is backed by a
law and has the powers to take penal action.

The DGCA
• The DGCA could set guidelines and directions
to airlines and airport operators.
• But the legal sanction behind these measures
were limited.
• The regulator could cancel the license of an
airline, or suspend a pilot or engineer, but
that may not be the ideal punishment for
each and every error.

The AAIB
• AAIB will look into investigative activities for
aircraft accidents.
• The central government can issue directions
to these bodies with respect to their activities
in public interest.

POWERS OF CENTRAL GOVERNMENT
• It may cancel the licenses, certificates or
approvals granted to a person under the Act
if the person contravenes any provision of the
Act.

VIOLATION OF GUIDELINES
• There is a provision of compounding of first or
rare contraventions of the acts.
• In other words, if an airline, which is
otherwise compliant, commits an error, the
DGCA or the other two agencies, can let it
pass.
• The first offence is compoundable. However,
the second offence within a space of five
years is not compoundable.

• Industry experts are hoping that the Bureau,
which is investigating the Air India Express
flight crash in Kozhikode that led to the death
of 18, will use these powers to come down
heavily on those found guilty.
