ARTICLE 370
• Article 370 gave special status to the Indian state of
Jammu & Kashmir, which was administered as a
state of India from 1954 to 31st October 2019.
• The region has been a subject of dispute between
India, Pakistan and China.

IN THE CONSTITUTION
• The article was drafted in Part XXI of the
Constitution: Temporary, Transitional and Special
Provisions. It established the Constituent
Assembly of Jammu & Kashmir to form its own
constitution.

PURPOSE
• Article 370 empowered Kashmir to have its own
state flag, a separate constitution and autonomy
over internal administration of the state.

WHY ARTICLE 370?
• The accession of the state of Jammu & Kashmir to
the Indian Union was unlike other princely states,
who chose that the country should have a single
constitution rather than a constitution for each
state.

JAMMU & KASHMIR
• Representatives to the constituent assembly of
Jammu & Kashmir requested that only those
provisions of the Indian Constitution corresponding
to the Instrument of Accession should be applied to
the state.
INSTRUMENT OF ACCESSION
• The Instrument of Accession signed by Maharaja
Hari Singh declared that the state shall not be
compelled to accept any future Constitution of
India and has the rights to frame its own
constitution.

REVOCATION OF ARTICLE 370
• On 5th August 2019, Union Home Minister Amit
Shah announced that The President of India
issued an order that stated all the provisions of
Indian Constitution applied to the state of J&K.
• Both houses of the Parliament later passed a
resolution introduced by the Home Minister,
which rendered all clauses of Article 370 as
inoperative, thereby revoking the article.

JAMMU & KASHMIR
REORGANIZATION ACT, 2019
• Along with revocation of Article 370, the Home
Minister introduced the bill which reorganized the
state into two union territories, Jammu & Kashmir
and Ladakh. The bill became an act after it was
signed by the President.
