NALP's 2025 lateral hiring survey reads well at the top line: total lateral hiring across responding U.S. law
offices rose 16.4%, with partner hiring up 17.8% and associate hiring up 17.1%. The spread underneath that
number is the part worth reading. Roughly 53% of offices saw only a small increase or an outright decline -
while lateral partner hiring in Austin rose 600%, the largest jump NALP recorded in any city.
Two more figures show where those seats sit. Ninety percent of the offices in that survey belong to firms of
more than 250 lawyers, so what it mostly measures is large-firm hiring - and in the same year, lateral partner
hiring at firms of 250 lawyers or fewer rose 88.7%. Texas is absorbing lateral talent, and much of it is
landing below the AmLaw line, in the mid-sized firms and boutiques where Constellation Search Group

Price your practice before
someone else prices it.
Your practice area sets the ceiling. Your firm's name does not.

Legal hiring is not one market. Immigration, family law, and environmental practices hire
on caseload, hearing volume, and time on your feet. Corporate and IP hire on a deal
sheet. Know which conversation you are in before you start it - the two price differently
and move on different clocks.
Be exact about what is portable, and what is not.
Portables change the conversation years before partnership does. Separate three things
in your own head: clients you originated, clients you service, and referral sources who
send work to the firm rather than to you. Overstating this is the fastest way to lose a
second meeting. Understating it leaves money on the table.
Texas licensing is a hard date, not a detail.
Texas licenses an out-of-state attorney two ways without another bar exam. Admission
without examination needs five of the last seven years in active practice. UBE score
transfer needs a 270 earned within five years - the old two-of-three years practice
condition was deleted in 2022, though it still circulates. Either route also requires an
MPRE of 85, the free 12-hour Texas Law Course, and about $1,040 in Board fees, and
the Board's own estimate is six to nine months. Firms will work around a timeline.
They will not work around a surprise.
Reality check. Most attorneys open with where they went to law school and where they work now. Neither is what
the firm is buying. It is buying coverage - the matters it can hand you in month one without supervising you. Lead
with that.

A lateral resume is a record,
not a pitch.
Lead with representative matters, not adjectives.
For each matter that mattered: the forum, your actual role, the scope, and how it
resolved. Second-chaired a three-day bench trial in Bexar County District Court tells a
hiring partner what they can hand you. Excellent litigator with strong attention to detail
tells them nothing, and reads as filler.
Report your hours honestly, and report their shape.
Give the billable target, what you actually hit, and then break it down - drafting, hearings,
depositions, client contact, and how much was review. Add the non-billable work firms
value: pro bono, supervising juniors, business development. A lower number with better
composition often wins.
Explain the gap or the detour in one line, in writing.
Firms slot laterals by class year, and anything that breaks the pattern - a clerkship, a
government stint, solo practice, time out, a lateral eighteen months ago - gets asked
about. Answer it in the cover note, in one sentence, without apology. Unexplained gaps
get filled in by the reader, and rarely in your favor.
Common mistake. Sending the resume you built for a clerkship application. A clerkship resume sells credentials -
school, journal, grades. A lateral resume sells capacity: what you can carry from day one without anyone checking
your work.

Run a confidential search,
and run it clean.
One recruiter per firm. No exceptions.
Duplicate submission is the most avoidable way to lose a job you were going to get.
When two agencies claim the same candidate, the firm inherits a fee dispute, and the
cheapest way out is to pass on you. Keep a written list of who submitted you where, and
never authorize a submission you did not ask for.
Texas is a big bar. Your section of it is not.
Immigration, family, and employment practices in any one Texas metro run on a bench
of firms small enough that an unmanaged search reaches your current firm before your
offer does. Every mass application, every job board profile, and every resume sitting in a
fifth database is a copy you no longer control. One search partner, submitting with your
written consent, keeps it in a single channel.
Ask the questions a job posting cannot answer.

The stated billable requirement versus what people there actually bill. How origination
and servicing credit are split. Whether the partnership tier is equity, non-equity, or both.
Why the seat is open and who sat in it last. A recruiter who has placed into that firm
knows all four before you interview.
What a direct hire partner does. Screens the firm before you spend an evening on it. Submits you once, with your
consent, and tells you where. Reads the offer against what that firm has actually paid recent laterals. Handles the
comp conversation so you are not negotiating against your future partners. And costs you nothing - in direct hire,
the firm pays.

Diligence the firm as hard
as it diligences you.
Raise conflicts early. They kill offers late.
Under ABA Model Rule 1.10, a lateral's former-client conflicts are imputed to every
lawyer at the new firm unless that lawyer is timely screened - on conditions that include
taking no part of the fee, prompt written notice to the affected former client, and
compliance certifications on request. States adopt their own versions. Firms run these
checks during recruiting, so disclose enough to let them run it while a screen can still be
built.
Negotiate the structure. Base is the smallest lever.
What counts toward the billable requirement - pro bono, business development, training,
committee work. How the bonus is set: lockstep, discretionary, or origination-based.
Whether there is a non-equity tier and how long people sit in it. Location is negotiable
now too: 52.1% of offices in NALP's 2025 survey reported policies permitting fully remote
lateral hires, up from 49.2% in 2024.
Do not resign until the paper is signed and cleared.
Executed offer letter, conflicts cleared in writing, start date confirmed, and if you are
crossing jurisdictions, your admission path confirmed by the bar rather than assumed.
Then give real notice and leave your matters in order. In a market this size, the partner
you leave is a reference for the next twenty years.
Reference tip. Brief your references on the practice you are moving into, not the one you are leaving. A useful
reference does not say she was a pleasure to work with. It says she ran our immigration docket of ninety active
matters and appeared at merits hearings on her own. Give them that sentence.
