NHQB Requirements For Builders
As mandatory NHQB requirements, all housebuilders must register with the 
NHQB. Then, they must follow the Code’s requirements and the mandate of 
the (once established) New Homes Ombudsman Service (NHOS). To enforce 
the Code, the NHOS will have the authority to require housebuilders to 
perform work or take corrective action and award compensation.

Registration
To become registered, a housebuilder must follow the required registration 
process, including completion of training and introduction of necessary 
complaints procedures to meet the requirements of the Code.

The Code
Developers and new home builders that are registered with the New Homes 
Quality Board are required to accept and abide by the mandatory 
requirements outlined in the New Homes Quality Code. For the avoidance of 
doubt, Joint Ventures between several parties when residences are built or 
modified for private sale are considered Registered Developers.

The Developer Guidance
The Fundamental Principles are crucial for interpreting the Requirements to 
satisfy the Customer, so the Guidance should be independent in this case. The 
Customer must not be worse off due to the Developer’s alternative strategy 
than they would have been had the Developer followed the Guidance. 
Therefore, developers are not required to adhere to the Guidance.

The Fundamental Principles
The Developer Guidance is an addition to the Code intended to help Registered 
Developers implement the Requirements. None of the Statement of Principles 
or Practical Steps of the Code is replaced or superseded by it. However, once it 
has been developed, it may occasionally be amended to reflect new industry 
best practices and judgments of a NHOS.

The Practical Steps
The Developer must offer a comparable degree of information and produce 
results that are at least as good as those suggested by this Guidance. Only 
where more specific information is required by the Requirements in the 
applicable section of the Code to help Developers comply with the 
Requirements is Guidance offered.
