What is the UK Spouse Visa?
The UK Spouse Visa, also called the Partner Visa, allows non-UK citizens
to reside in the UK with their British or settled partner.
It falls under the UK Family visa category and allows holders to work or
study without restrictions.
A UK Spouse Visa is based on an individual's right under Article 8 of the
European Convention of Human Rights.
The UK Spouse Visa permits living, working, and studying in the UK. It
also enables individuals to apply for Indefinite Leave to Remain (ILR) and,
ultimately, British citizenship.
The spouse seeking entry to the UK must be granted entry clearance
before arrival. If you apply as a fiancé(e), you will be granted entry for six
months to marry.
Following the marriage, you will need to apply for a Spouse Visa.
The initial Spouse Visa is valid for 33 months if you are applying from
outside the UK. If applying from within the UK, the visa is valid for 30
months.
Extensions are available for a further two and a half years, bringing the
total stay to five years. After five years, individuals are eligible to apply
for ILR.
Who can apply for a UK Spouse Visa?
You can apply for a UK Spouse Visa if you are over 18 years old and
married to or in a civil partnership with a British citizen or a person with
settled status in the UK.
You can also apply if you have been living together in a relationship for
at least two years and can prove it.
Individuals with a fiancé(e) or proposed civil partner can also apply if
they intend to get married in the UK within six months.
Partners eligible to sponsor a spouse for this visa
include someone who:
1. Is a British or Irish citizen
2. Has settled in the UK (indefinite leave to remain, settled status
or proof of permanent residence)
3. Has pre-settled status (must have started living in the UK before
1 January 2021)
4. Has a Turkish Businessperson visa or Turkish Worker visa
5. Has protection status (leave to remain as a refugee, permission to
stay as a refugee or a person with humanitarian protection).
The applicant must intend to live together permanently in the UK with the
sponsoring partner.
Applicants must also provide evidence of a genuine and subsisting
relationship.
