Type of Court Marriage: -
> MARRIAGE WHEN BOTH PARTIES ARE THE SAME
CASTE: -
For getting married between two parties, both girl and boy must be of the
same caste. In the presence of two witnesses, both can easily get married in
front of the registrar. But when the marriage is being held between people of
the same caste, then it has certain conditions, such that there should
be no blood relation between the two, there should be no real
relationship.
> MARRIAGE WHEN BOTH PARTIES ARE INTER-
CASTE: -
Inter-caste marriage is a marriage where one of the spouses is of another
caste and one of the spouses is from non-scheduled caste. The law made for
inter-caste marriage should be in accordance with its rules and should be
properly listed under the Hindu Marriage Act, 1955. It is mandatory to
submit an affidavit of marriage for acceptance.
> MARRIAGE IN CASE BOTH THE PARTIES BELONG
TO INTER-RELIGIONS:
Marriage done under the Special Marriage Act, 1954 is a civil contract and
there are no rites or formal requirements. Where one or both husband and
wife is not Hindu, Jain, Buddhist or Sikh. Marriages can be easily
registered under the Special Marriage Act, 1954, irrespective of
religion and the marriage can be executed.
> COURT MARRIAGE OF AN INDIAN AND A FOREIGN
NATIONAL: -
Marriage between two parties out of which a person must be a citizen of
India is kept under the Special Marriage Act. This special marriage is done
before registering a marriage in India or before a marriage right in a foreign
country.
Condition of Court Marriage in Delhi :-
1) To m arry in court, the minimum a ge qualification for t he bride and groom
is 1 8 and 21 respectively.
2) Moreover, if the s pouse of a person is dead or if the p erson has divorced
their partner then the spouse can marry with other person according to his
or her choice.
3) An Indian individual can marry even with a foreigner. A court marriage
allows Indians to marry foreign individuals if they a re not married in their
own countries.
4) A court m arriage is carried in the presence of t he marriage officer. A lso,
p eople of any caste and religion can marry each o ther p rovided that they
a re not related as p er the forbidden degrees o f the w edding.
Documents Required for Court Marriage In
Delhi:-
1) Four P assport Size Photographs of Groom and Bride .
2) Address Proof like (Voter Card / D riving License / Bank Passbook /
Passport / Rent Deed / L ease Deed ) of Bride and Groom.
3) Groom and Bride Date of Birth Proof like (Municipal Corporation
Certificate, 1 0th o r 12th Examination Certificate, Passport, Birth
Certificate)
4) In Case Of Divorcees: Divorce Decree Certificate Must
5) In Case Of Widower and Widow: Municipal Death Certificate Of Person
Must Be Produced.
6) If any p arty is a F oreign Citizen or h aving foreign residential address and
holding a f oreign P assport – Certificate of Marital Status of the p arty /
N o Impediment Certificate / V alid VISA and NOC from concerned
Embassy .
7) Two W itnesses (Both should be m ajor) .
Total Time Taken for the Entire Process of
Court Marriage: -
The entire process takes a maximum of 60 days from the start of the
notice. It provided that if no objection comes up within 30 days from the
date of publication of the notice. If there is any objection in the
marriage, then the marriage officer is given a maximum of 30 days
to investigate. An appeal can be made to the District Court within 30 days
of the date of the decision by the Marriage Officer after the Marriage Officer
has raised objections.
Same Day Court Marriage in Delhi
1) The entire process is done by Delhi NCR.
2) The age of the bride must be 18 years and the age of the groom must be
21 years
3) Two witness are required then they can be friends, relatives, parents
or neighbors
4) The entire process is completed in 2 to 3 hours.
5) Both sides have one of the Hindu, Jain, Buddhist or Sikh
6) You can choose one day between Monday to Friday. But there should be
no public holiday on that day
7) Bride and Groom of Witness will he Can be from India or Abroad.
8) Any notice or any information related to it is not sent to the address of
Groom and Bride.
9) Both Arya Samaj or Court Marriage Certificates are issued on the same
day, which is valid all over the world and cannot be challenged in any way.
Document Needed For same day Court
Marriage In Delhi:-
1) Six Passport Size Photographs of Groom and B ride
2) Address proof like Aadhar card, voter card and Passport of bride and
groom
3) 2 passport size photo of both party witness
4) In case anyone is divorcees:- Divorce Decree Certificate copy
5) In case Widower or Widow:- Death certificate of spouse.
