(SFC), which is an independent statutory body, is charged with implementing regulations that business entities as well as 
members of the sector are supposed to follow.
• Hong Kong SFC enforces regulations that require financial service firms to record mobile messages, capture mobile calls, 
and other types of communication. Failure to follow these regulations to the books can lead to major financial 
consequences and severely damage public trust as well as the reputation of your organization.

• There are various Hong Kong’s SFC  recording requirements for business communications you need to 
know.  One of them is about the period of retention of electronic communications. According to the 
Section 10(d) of the Keeping of Records Rules, the records that show the particulars of all orders received 
or initiated by the intermediary are supposed to be retained for a period of not less than 2 years.
•  Another SFC recording requirement you need to know has to do with fines for non-compliance. 
According to Section 12 of the Keeping of Records Rules, an intermediary or an associated entity, which, 
with intent to defraud the rules, commits an offense, is liable to a number of penalties and charges, 
including on conviction on indictment to a fine of HK$1,000,000 and imprisonment for seven years; or on 
summary conviction to a fine of HK$500,000 and imprisonment for a year.
